Ninth Circuit Court Rules in Favor of Perplexity in Amazon AI Shopping Case

The Ninth Circuit Court overturned a previous injunction, stating that Amazon is unlikely to prove that Perplexity's AI shopping agent violated the Computer Fraud and Abuse Act.

The court placed more responsibility for "access" on users rather than on Perplexity itself, marking the first time an appellate court has clearly addressed the legal boundaries of AI agents placing orders on behalf of users.

Buying interest will lean more towards agent-based AI, browser automation, and trading assistants, while selling pressure will fall on e-commerce platforms that rely on blocking traffic; such rulings directly benefit the commercialization expectations of AI Agents.

This case fundamentally changes not Perplexity itself, but the legal definition of whether "AI agents count as users." Amazon previously kept AI agents at bay using the CFAA and platform authority logic, but now the appellate court has pried the door open, indicating that the judicial system is beginning to recognize that "authorizing users does not automatically authorize agent representation."

In terms of capital pathways, Perplexity's Comet browser represents a new generation of interfaces that "help users complete transactions," while Amazon represents a platform that controls traffic, advertising, and settlement pathways. If AI agents are allowed large-scale access, profits will shift from platform-guided sales and advertising to the agent layer, search layer, and task execution layer.

A comparable historical case is the long-standing conflict between browser plugins, price comparison tools, and automated crawlers with platforms: when new tools lower the cost of switching for users, platforms typically first block them with terms and technology, then enter judicial battles. The current phase resembles the beginning of an "agent economy," rather than its conclusion.

At its core, this is a transfer of pricing power: whoever controls the entry point for users to complete transactions controls the conversion rate and commission distribution; this shift occurs because AI agents automate web behaviors that previously required human operation, thus challenging the platform's lock-in advantages.
