U.S. tech companies reach out to Democrats to prevent House takeover

The Wall Street Journal reports that some U.S. companies closely associated with President Donald Trump have begun to court Democrats and hire consultants to prepare for potential investigations if the Republican Party loses control of the House of Representatives. Large tech companies are particularly notable, especially those that made significant donations to Trump's legacy projects.

Consultants, lobbyists, and board members say these companies are preparing for congressional inquiries and even potential criminal investigations. Washington lawyers and lobbyists relay clients' concerns: "Where are our vulnerabilities?" Meta Platforms is named as one of the companies that has donated to Democratic political committees.

Preparations are already underway at law firms. Christopher Armstrong, a partner in congressional investigations at Holland & Knight, states that if Democrats regain the majority, they are expected to target private companies directly. Potential subjects of oversight include Amazon and Walmart, which have been questioned about pricing, as well as Apple, Microsoft, Nvidia, and Meta, which have donated to the White House banquet project and have already received inquiries from Democratic lawmakers.

Palantir has hired lobbyists with Democratic backgrounds, including Cristina Antelo and Debra Dixon from Ferox Strategies, as well as former Democratic Senator Mark Begich, to prepare for potential subpoenas after the Republican-controlled session. Akin Gump has brought in Democratic congressional investigation veteran Marcus Childress to co-lead their congressional investigation practice. Maryland Congressman Jamie Raskin, if he heads the Judiciary Committee, has previously sent letters to Apple and Alphabet regarding the removal of immigration enforcement-related applications.

If Democrats regain the House in the midterm elections in November, they will gain subpoena power, committee control, and a platform for public pressure. House Minority Leader Hakeem Jeffries is already planning multiple investigations into the Trump administration and its allies, while the White House is preparing for a wave of subpoenas. There are still divisions within the party regarding where to focus their efforts and whether to pursue a third impeachment of the president.

The buyers are companies fearful of subpoenas and their compliance budgets, while the sellers are Democratic lawyers and lobbyists who are re-quoting after being sidelined for a year. Funds are flowing from political action committee donations and consulting fees to K Street, representing a midterm election-driven hedge rather than business expansion. Benefiting are those with dual connections who can speak to both sides; under pressure are tech and defense contractors who have overly bet on Trump and have written checks for legacy projects like the banquet hall.
