SOHO China founder and Closer Media producer Zhang Xin has framed the distribution dispute of Alex Gibney's documentary "Musk" as a symbol of free speech. She is one of the producers of the film, which was publicly announced to premiere in Venice and Toronto in August. Her latest statement elevates the distribution tug-of-war from scheduling issues to a matter of principle.

The film runs nearly four hours and will have its world premiere in the non-competitive section of the Venice Film Festival on September 8, followed by its North American premiere in Toronto. U.S. distributor Bleecker Street has moved the release date up by a week due to reviews and demand: it will first screen in New York and Los Angeles on October 9, expand to major cities on the 16th, and then enter paid video-on-demand. HBO's documentary division holds the North American television and streaming rights, planning to air it in Q1 2027. The overseas theatrical rights were acquired in 2023 by Universal Pictures Content Group from Black Bear for several million dollars; specific dates for various regions have yet to be announced.

There is a temperature difference in the distribution side. Hollywood Reporter cites insiders saying that Comcast's Universal has cooled its stance and has not communicated with the production team about scheduling, with some speculating that they may ultimately withdraw their rights. Universal has stated that it remains committed to overseas theatrical releases and is strategizing, but declined to comment on specific dates. Comcast is also facing an investigation by the Trump administration's Federal Communications Commission regarding its diversity policies. The film's content has been described by Venice critics as a ruthless examination of Musk from his entrepreneurial beginnings to his involvement with X and DOGE, with Gibney and Zhang Xin also attending the Toronto premiere.

The subject of the film has referred to it as a "hit piece" since its inception in 2023. After the Venice screening, Musk again called the director a "painful old man with zero integrity" and claimed the film was boring. Lawyer Alex Spiro threatened to file a defamation lawsuit before the October release, pointing to text messages between Musk and Ashley St. Clair in the film. Jigsaw Productions responded that public scrutiny of powerful figures based on facts is protected by the First Amendment, and those who claim to be absolutists of free speech should acknowledge this. Gibney stated that he received "nothing" after legal inquiries to the other party.

The capital structure divides the same film into three market segments. Independent U.S. distributors take political risks to change release dates; HBO locks in a long video window, while waiting to see if Warner Bros. Discovery's new owner David Ellison will change the script; Universal has paid for international rights but is stuck due to sensitive relations with Washington. Closer Media has included the cultural capital of a Chinese developer in the production credits, but the distribution rights are caught in the political calculations of major U.S. companies. There are no new box office numbers, only release dates, withdrawal of rights, and threats of lawsuits determining the pricing.

In market mechanisms, buyers want to see the holiday audience and subscription users for a four-hour investigative documentary, while sellers are Bleecker, Universal, and HBO. The event-driven aspect is the major companies' risk assessment of offending Trump's circle. Funds have already been tied up in international copyright transactions in 2023, and what is currently flowing are commitments to release dates. Beneficiaries are independent filmmakers who can frame narratives of censorship as promotional material; under pressure are the group distribution departments that have already acquired overseas rights but are hesitant to set dates, as well as those who portray their platforms as absolute free speech yet use legal letters against the subjects of documentaries.
