The U.S. Commodity Futures Trading Commission (CFTC) updated its FAQ on cryptocurrency and blockchain, clarifying that futures brokers and clearing organizations can use customer funds to invest in "tokenized forms of approved assets." Registered entities can also use blockchain to meet statutory record-keeping requirements.

The document, numbered 9303-26, dated September 24, added FAQs 12 to 15 and revised FAQ 5. Chairman Michael Selig stated this provides ongoing regulatory clarity for the crypto industry. Staff opinions do not equate to a commission vote and do not imply approval of any specific token or public chain.

Investment of customer funds remains subject to Regulation 1.25. Tokenized forms must meet four criteria: the underlying asset is on the approved list; the token confers legal and economic rights equivalent to traditional forms; it complies with liquidity, concentration, and maturity limits; and the tokens are held by an acceptable custodian. Tokenized government money market funds also require written confirmation from the fund custodian. Payment stablecoins are still not on the list of investable customer funds.

The record-keeping rules are written to be technology-neutral. Regulation 1.31 and swap data rule 45.2 do not mandate paper or off-chain copies; staff indicated they do not oppose maintaining records solely on-chain. Institutions using public permissionless chains must have their own systems to submit records to regulators even during network or blockchain browser outages. These issues stem from a June 16 request for comments, with feedback provided by dYdX Labs, Blockchain Association, and Solana Policy Institute.

Previously, staff letters 25-39 (guidance on tokenized collateral) and 26-05 (non-action stance on digital assets as margin) were issued. The investment of customer funds and margin eligibility are treated separately: tokenized government bonds or money market funds can proceed under 1.25, but this does not automatically qualify crypto assets as eligible margin for uncleared swaps. Following the stagnation of the Clarity Act legislation, the commission opted to proceed with staff documents under existing authority.

In market mechanisms, buyers need to place idle customer funds into tokenized government bonds and money market funds through FCMs and clearinghouses, while sellers must provide tokens that confer equivalent rights, qualified custody, and auditable ledgers; funds flow from brokers' segregated accounts to tokenized traditional assets, rather than to speculative coins. Beneficiaries are the government bond tokens and on-chain record-keeping infrastructure, while those under pressure are stablecoins and highly volatile crypto assets that remain outside the 1.25 list. The event is driven by regulatory FAQs, not by the price fluctuations of any specific public chain.

On-chain verifiability refers to the guidance text, not the immediate scale of customer fund migration; the ability to gather evidence during public chain outages will become a compliance bottleneck before "full on-chain" becomes a reality.
