Former Polish police officer Artur K. has been arrested in connection with the now-defunct cryptocurrency exchange Zondacrypto, charged with participating in an organized crime group, causing significant property damage, embezzlement of entrusted property, computer fraud, and money laundering. Law enforcement officials seized documents related to the exchange's operations during a search of his residence.

Artur K. was detained by the Central Bureau of Cybercrime (CBZC) on Tuesday, with the detention order issued by the organized crime department of the Polish National Prosecutor's Office. Police are also searching the fuel depot where the exchange's founder, Sylwester Suszek, was last seen before disappearing in March 2022. The prosecution has reclassified Suszek's case from "missing" to "illegal deprivation of liberty"; another suspect is accused of removing the hard drives from the gas station's surveillance cameras.

Suszek was last seen on March 10, 2022, driving to a gas station in Czeladź to meet organized crime figure Marian W., who is suspected of participating in VAT fraud. His phone signal was last detected at the gas station at 3:08 PM that day, after which he disappeared. Suszek's sister publicly expressed her belief that her brother has been murdered and stated that she continues to receive threats. On July 30, the prosecution merged Suszek's disappearance case with the Zondacrypto fraud case.

Zondacrypto was originally founded by Suszek in 2014 as BitBay, Poland's first large cryptocurrency exchange. In 2020, it relocated its registration to Estonia, operating under BB Trade Estonia OÜ, and later rebranded to Zondacrypto, claiming to have 1.3 million customers, primarily from Poland. By April 2026, on-chain data showed that the exchange's operational wallet's Bitcoin reserves plummeted from an average of about 55 coins per month to 0.086 coins, a decrease of 99.7%. CEO Przemysław Kral immediately claimed this was an "analytical error," asserting that the company held over 4,500 Bitcoin in reserves and promised to resume withdrawals on April 12, but consistently refused to provide proof of reserves through a cryptographic audit. On April 22, Kral issued a farewell statement from Monaco, and the company subsequently fired its employees. Investigations indicated that about 4,500 Bitcoin in the company's cold wallet had been unaccounted for since 2022.

Regulatory and judicial procedures have been fully initiated. The Estonian Financial Intelligence Unit partially suspended the exchange's license on May 18 and revoked it on June 29; the Harju County Court in Estonia froze the company's assets on July 27 and declared BB Trade Estonia OÜ bankrupt on August 27, with the deadline for creditor claims set for October 27. The prosecution estimates losses of at least 350 million zlotys (approximately $9.4 million to $10 million), with affected users ranging from 30,000 to 57,000, and over 3,600 complaints received by mid-2026. The company owes clients 722.4 million euros, along with a 75 million euro unsecured cryptocurrency loan to an unidentified borrower. The Polish prosecution has frozen over 100 million zlotys in assets and an additional 4 million euros in bank deposits in France.

Artur K. is at least the sixth suspect charged since August. On August 27, Radosław P., the president of the Polish Olympic Committee, was charged with receiving benefits for engaging in paid influence trading and prioritizing certain creditors for repayment before the company's impending bankruptcy, and has been detained for three months. From September 2 to 4, Anna P. was charged with participating in an organized crime group from 2020 to 2026 and removing the gas station's surveillance hard drives; Marian W.'s ex-wife, Jaromira W., was charged with transferring about 8 million zlotys to French real estate and laundering 7.5 million zlotys; well-known Polish trader Rafał Z. was charged with embezzling 1.7 million zlotys entrusted to the exchange's operating entity. On September 5, Suszek's long-time business partner Roman Ż. was detained, involved in 7.8 million zlotys, with police seizing watches and documents. CEO Kral reportedly cooperated with the investigation as a "tainted witness," with Roman Giertych as his defense attorney.

From a market mechanism perspective, this is an asset recovery driven by criminal investigation, not a market trading event. The sellers are users forced to stop-loss: after the exchange halted withdrawals, they can only queue for compensation as creditors through bankruptcy proceedings. The buyers are the bankruptcy administrators and prosecutors: they are freezing and recovering properties, deposits, and crypto assets dispersed across Poland, France, and other locations. The flow of funds indicates that user assets had already been transferred out of the exchange before its shutdown through unsecured loans, related party transfers, and real estate purchases. The beneficiaries are compliant exchanges that have obtained EU MiCA licenses, which will take over Polish users flowing out from domestic platforms; the pressured parties are small to medium exchanges registered in offshore jurisdictions that operate for Polish users but lack local regulation, as well as Polish sports organizations involved in this case due to sponsorship relationships.

Supplementary data: Poland currently has no dedicated regulatory agency for crypto assets, and the transitional period for the EU MiCA ended on July 1, 2026. On September 4, the Polish parliament made a third attempt to overturn the president's veto of the "Crypto Asset Market Law," which again failed.
