The Blockchain Association and the Crypto Council for Innovation have submitted a 34-page motion to the Sangamon County Circuit Court in Illinois, seeking a preliminary injunction to block the digital asset transaction tax set to take effect on January 1, 2027.

This tax imposes a 0.2% levy on the value of digital asset transactions or related services provided to customers in the state, signed into the budget by Governor JB Pritzker. It primarily affects service providers such as exchanges, custodians, and brokers, with entities reaching a total revenue threshold of approximately $100,000 required to collect and remit the tax. The groups argue that the tax law is unprecedented, requiring members to invest millions of dollars to build compliance systems without effective guidance, and facing criminal penalties; even if compliance is achieved, the law will cause irreparable harm. They claim it violates the state constitution's principle of equal taxation and discriminates against digital assets, while also violating the federal Internet Tax Freedom Act's restrictions on discriminatory e-commerce taxes, as well as dormant commerce clause and due process rights.

Industry experts point out that exchanges, transfers, and custodians could be taxed on the full value of assets, regardless of whether profits are realized. In August, the two groups filed a lawsuit, with The Digital Chamber following up in a separate case. The governor's office has not responded to requests for comment. The lawsuit itself does not automatically stay the law; a court ruling on the injunction is required.

If the injunction fails, service providers will either need to redesign their tax engines or reduce services to customers in the state. Individuals must self-report by the 20th of the following month if the provider does not withhold taxes.

From a market mechanism perspective, this is a clash between state taxes and full on-chain circulation: while 0.2% seems minimal, when applied to buying, selling, and transferring, it becomes a turnover tax. The beneficiaries are the revenue sources for the state budget; the burden falls on trading and custody platforms serving Illinois residents, as well as national exchanges that must modify their systems. Funds may be moved out of state accounts in advance or redirected through channels that do not reach the definition of Illinois customers.

January 2027 is a hard deadline. If the court issues an injunction before then, compliance costs can be halted; if not, system modifications will already be sunk costs.
