Schumer Proposes Anti-Corruption Agency Establishment Act

Senate Minority Leader Schumer has introduced the Anti-Corruption Agency Establishment Act.

The primary goal of the bill is to return money to the American people, allowing citizens and state attorneys general to sue to recover funds obtained through government corruption.

The new independent anti-corruption agency will consolidate existing agencies, have subpoena power and enforcement authority, and will be led by seven commissioners, retroactive to January 20, 2025.

Schumer has previously voiced concerns about the business ties and ethical issues of the Trump administration, and this time he has collaborated with several Democratic senators to introduce comprehensive legislation.

On the path of capital and power, the bill grants private litigation rights to recover so-called improper gains, while establishing a new independent agency to replace the fragmented ethics and election oversight functions, attempting to create a long-term constraint mechanism.

Similar to the ethical legislation following the Watergate scandal and more recent foreign influence disclosure rules, the U.S. is currently in a phase of redefining the boundaries between executive power and business interests.

Essentially, this represents a regulatory change, raising the cost of corruption during and after a president's term through a dual mechanism of private litigation and an independent agency.

  2. The independent agency is a physical carrier of power checks and balances.

  3. Private litigation turns the public into overseers.
