The German Federal Ministry of Finance has drafted a proposal to treat the sale proceeds of cryptocurrencies such as Bitcoin and Ethereum as capital gains, moving away from the current rule that allows private asset sales to be tax-free after one year of holding.

The draft proposes a withholding tax of 25%, similar to that applied to stock investment gains, with an additional solidarity surcharge bringing the total burden to approximately 26.375%, excluding church tax. The existing tax exemption for assets held for over a year will be abolished, meaning the holding period will no longer determine tax liability.

The new regulations are intended to primarily cover positions acquired after December 31, 2026, while existing holdings will still be treated under the old rules. The law is set to take effect on January 1, 2027, but automatic withholding by cryptocurrency service providers will be delayed until January 1, 2028, to allow platforms to complete technical upgrades.

The Ministry of Finance estimates that the reform could increase tax revenue by approximately €160 million by 2028, rising to about €350 million by 2031. The rationale is that cryptocurrencies have high liquidity and speculative characteristics, making them more akin to traditional capital assets rather than other private property.

Under current rules, sale proceeds from holdings over twelve months are generally tax-free; sales within a year are subject to personal income tax rates, which can be as high as 45%, with a €1,000 annual exemption for private sales. The draft also discusses including income from lending and staking under capital gains treatment.

From a market mechanism perspective, this is driven by tax policy rather than market conditions: long-term holders will lose their tax-free exit, while short-term traders may see their tax rate drop from a maximum of 45% to a fixed rate of about 25%; custodial and trading platforms will bear withholding obligations, benefiting from compliant tax reporting and on-chain accounting services, while platforms that do not complete their withholding systems will face pressure. Funds are more likely to adjust positions before the deadline or shift to existing coins that still follow the old rules.

This draft is still in the early stages of internal government coordination and must go through the legislative process, with terms potentially subject to change. There are also discussions at the EU level about treating cryptocurrency capital gains as a common budget resource, aligning Germany's move with the direction of reclassifying cryptocurrencies from "other economic properties" to capital income.
