The post did not include an executive order, congressional bill, or treaty text, nor did it specify boundaries, governing bodies, or registration procedures. The White House's previous policy was for Americans to return to the moon by 2028 via Artemis, establish initial facilities for a permanent lunar outpost before 2030, and plan for a nuclear reactor on the lunar surface.

Article II of the 1967 Outer Space Treaty states that celestial bodies, including the moon, cannot be claimed by any nation through sovereignty, use, occupation, or any other means. The US is a party to this treaty; the 1979 Moon Agreement asserts that the moon and its resources are the common heritage of mankind, which the US has not joined.

A 2020 executive order clarified that the US does not view outer space as global commons and encourages commercial recovery and use of space resources. During the acting director's tenure in 2025, it was publicly stated that the goal was to occupy lunar regions with ice and sunlight first; in 2026, NASA advanced lunar base procurement, selecting lunar rovers and landers.

The Apollo missions planted flags, but the US government has never completed domestic legal registration of territory on the moon. Private sales of lunar land deeds have appeared since the 1980s, but they cannot be effective in national land registration systems due to the lack of a sovereignty basis.

Mechanically, buyers are commercial space companies seeking mining rights and outpost contracts, while sellers are US administrative departments controlling launch, nuclear power, and procurement rights. The event is driven by social media sovereignty rhetoric, with funding flowing to Artemis, commercial landers, and nuclear power bids; beneficiaries are contractors who can secure lunar mission orders, while other treaty parties relying on Article II of the Outer Space Treaty to prevent unilateral delineation are under pressure.

Public information does not show that the State Department submitted a sovereignty declaration to the United Nations, nor does it show that US mapping agencies have incorporated the moon into domestic territory codes.
