X won this request; it was also determined that the opposing party is likely to prove that X has stopped good faith use and has no intention of restoring the term Tweet and the blue bird logo.

Key evidence overwhelmingly favored the name: the Apple App Store listing still states "Welcome to X (formerly known as Twitter)," leading the judge to believe that the Twitter name has not been entirely abandoned. The bird and Tweet do not appear on the main site x.com or in the store listing; X's submitted old web pages, dormant social accounts, deactivated accounts, and a vendor onboarding email were deemed insufficient to constitute commercial use. Musk publicly stated in 2023 that he would bid farewell to the Twitter brand and all birds, using a blowtorch to remove the bird logo from the building, which was written as strong evidence of no intention to restore use. The injunction is contingent upon X posting a $500,000 bond, while the opposing party had claimed at least $50 million in guarantees; the judge stated that their claim of ten million users and a first-year revenue forecast of $55 million lacked support. Bluebird has renamed its test site from Twitter.now to Tweet.app. X filed the lawsuit in December 2025, with the formal trial scheduled for November 2027.

Among the co-founders of Bluebird is former Twitter trademark lawyer Stephen Coates, who claimed to have preserved the bird and Tweet. The case is running parallel to an application to the Patent and Trademark Office for cancellation of registration, with the preliminary ruling not equating to final ownership.

In market mechanics, the buyers are users and advertising agencies still referring to the product as "Twitter," while the sellers are the renamed X and the startup trying to salvage brand remnants; the driving force is the statutory presumption of non-use three years after renaming. Funds are shifting from domain and brand recall budgets to litigation and bonds. Beneficiaries include X, which can still prohibit others from calling themselves Twitter, and Bluebird, which can launch with Tweet.app; those under pressure are nostalgic traffic treating the bird as an asset and X's legal team, which must explain the verbal farewell as still in use.
