For leading players like OpenAI, Anthropic, and Google, this represents both compliance costs and entry barriers; for smaller labs, it may become additional release friction.

Historically, U.S. AI regulation has oscillated between "innovation first" and "safety review"; today's version seems to embed safety review into the release process rather than holding accountability afterward. Similar ideas are common in cybersecurity, financial anti-money laundering, and critical infrastructure regulation: first, let a few large institutions bear disclosure obligations, then extend the standards to the entire industry.
