The CLARITY bill aims to establish a federal framework for classification, regulation, and market structure in the digital asset market, focusing on the jurisdictional boundaries between the SEC and CFTC, as well as the responsibilities of trading platforms and intermediaries. The industry hopes to replace the long-standing case enforcement risks faced by projects, exchanges, and custodians with codified rules.

A key obstacle to the bill is the ethics provision. Senate Democrats are concerned about potential conflicts of interest arising from Trump and his associated crypto businesses, and whether related provisions can be included in the final text will directly affect bipartisan support; unresolved issues also include stablecoin incentives and competition with the banking sector.

The Senate plans to hold its first procedural vote on September 15. This vote will determine whether the bill can overcome procedural hurdles and proceed to further consideration, but it does not equate to final passage; subsequent steps still require Senate approval, coordination with the House text, and presidential signature.

In terms of market mechanisms, crypto exchanges, custodians, stablecoin issuers, market makers, and tokenized asset platforms are direct buyers of regulatory clarity, with funds directed towards U.S.-registered entities, bank access, compliance systems, market monitoring, and asset isolation capabilities. The event is driven by legislative coordination; if the White House pushes for a compromise on the ethics provision, compliant trading platforms and U.S. market infrastructure valuations will benefit; if the procedural vote fails or negotiations stall, businesses will continue to rely on offshore entities, geographic restrictions, and private placement structures, with legal risk discounts continuing to suppress U.S. business expansion.
