Illinois Releases Draft for Crypto Transaction Tax Implementation

Illinois has announced a draft for the implementation of a digital asset tax, proposing to tax crypto-related transactions based on total asset value starting January 1, 2027, regardless of profit or loss. The tax rate has been set at 0.2% as per the previously passed digital asset tax law.

This law was signed by Governor JB Pritzker in June 2026 along with the 2027 fiscal budget proposal, officially named the Digital Asset Tax Law, included in Senate Bill 3019 as part of a revenue package. The tax base is not capital gains, but the asset value involved in "digital asset business activities" such as exchanges, transfers, or custody conducted by brokers for Illinois clients. The industry estimates an annual revenue increase of about $60 million.

The tax obligation falls on digital asset brokers. Platforms operating in the state must register to withhold taxes; out-of-state platforms that earn over $100,000 from Illinois clients within a rolling 12-month period are also included. Determining factors include the client's location in the state, account information, mailing address, or IP data indicating primary usage in the state. Brokers must report monthly, generally submitting electronically by the 20th of the following month.

Activities are counted per occurrence; the same batch of assets may be counted multiple times if exchanged, transferred, and then custodied. Peer-to-peer transfers between personal wallets are generally not within the broker's withholding scope, but transfers, trades, and storage occurring through exchanges or custodians may trigger it. If taxes are not withheld, clients must pay the state tax department directly.

Industry organizations have filed lawsuits claiming the tax violates dormant commerce clauses, arguing that traditional assets like stocks and bonds do not face equivalent transaction taxes. Miles Jennings, policy head at a16z, has called it one of the most anti-crypto state laws in the U.S. There is also a repeal proposal in the state legislature, but the effective date still points to January 1, 2027, with the draft aimed at filling execution gaps such as "how value is calculated and what constitutes a single business activity."

Market-wise, this represents a regulatory-driven cost repricing. The seller is the state treasury, while the buyers are Illinois clients and platforms like Coinbase and Kraken that must withhold taxes. Funds flow from transaction principal to the state treasury, putting pressure on high-frequency traders and custodial users, while self-custody wallets and platforms that withdraw clients from the state may benefit. The event itself does not change federal capital gains tax but creates a new tax base for "moving assets," increasing transaction friction.
