Vietnam Issues Decree Punishing Unauthorized Cryptocurrency Trading

The Vietnamese government has issued Decree No. 284/2026/NĐ-CP, establishing an administrative penalty framework for unauthorized cryptocurrency trading activities.

Investors trading on unlicensed platforms face fines of up to 50 million VND (approximately $1,900), while unauthorized issuance of crypto assets and serious violations of anti-money laundering regulations can incur fines of up to 200 million VND (approximately $7,700). Regulatory authorities are empowered to suspend operations, revoke licenses, and confiscate assets. This decree takes effect on September 1.

This event drives capital towards the upcoming regulated crypto platforms, with compliant trading platforms and licensed institutions becoming buyers of funds, while unlicensed operators and high-risk traders face pressure. Local crypto adopters in Vietnam benefit from the market certainty brought by legalization.

Vietnam previously opened applications for domestic cryptocurrency trading platform licenses in January this year. Deputy Minister of Finance Nguyen Duc Chi stated in May that the regulated market is expected to launch in the third quarter. This decree continues its historical path of transitioning from a high adoption country to regulated oversight.

On the capital front, the government aims to guide digital asset trading from the gray area to licensed platforms through administrative penalties and enforcement powers, focusing resource mobilization on building AML compliance infrastructure. The motivation is to balance high trading volumes (over $220 billion in 2024-2025) with financial stability needs.

Similar to Singapore or the UAE, which regulate the crypto market through a licensing and penalty framework, Vietnam is currently in a transitional phase from wild growth to regulated maturity in the crypto industry.

Structural Judgment Essentially, this is a regulatory change: emerging markets with high crypto adoption rates (ranked fourth globally) are reshaping market rules through progressive penalties and licensing systems. Mechanically, this is a necessary response to the increased scale of capital flows concerning money laundering risks and tax control, promoting the concentration of compliant capital.
